TERMS OF USE

1.1. These Terms of Use (hereinafter – the “Terms”) establish the conditions and procedure under which users may use the platform “Naudokis” (mobile application and website) managed by MB “Naudokis” (hereinafter – the “Company”). 1.2. Service provider: MB “Naudokis”, registered address – Numėjos g. 6, LT-08402 Vilnius, company code 307423504, email info@naudokis.lt. 1.3. By using the platform, the user confirms that they have read the Terms and agree to comply with them.

2.1. “Naudokis” provides a technological tool (platform) where users can post items for rent and rent items from other users. 2.2. The platform itself is not the owner, lessor, or lessee of the rented items. All transactions take place solely between users. 2.3. The Company acts as an intermediary, ensuring a convenient reservation, payment, and settlement process.

3.1. Registration on the platform is required to use the services. Only adults (18 years and older) may register. 3.2. The user must provide accurate and complete information during registration and is responsible for its accuracy. 3.3. The platform has the right to request user identity verification (KYC) to ensure security and legal compliance. 3.4. The user is responsible for the security of their account data and assumes liability for all actions performed using their account.

4.1. Users may post rental listings free of charge. 4.2. It is prohibited to list: • items whose rental is against the law; • dangerous, illegal, or prohibited items; • fake, misleading, or fraudulent listings. 4.3. The user who posts a listing is responsible for its content. 4.4. The platform has the right to remove listings that do not comply with the Terms or legal requirements.

5.1. Reservation process: • The lessee submits a request; • The lessor receives a notification and accepts or rejects the reservation; • Once the reservation is confirmed, the transaction is considered concluded; • At the end of the rental period, the transaction is completed. 5.2. The lessee undertakes to return the item on time and in the same condition as received. 5.3. In case of disputes or violations, the parties must first contact the platform for assistance.

6.1. At the time of reservation, the lessee’s funds are charged and securely held (escrow) until the transaction is completed. 6.2. After the transaction is completed and confirmed, the funds are transferred to the lessor, deducting the platform’s commission. 6.3. The commission fee is [XX %] of the transaction amount and is deducted automatically. 6.4. The platform ensures that payments are processed through licensed payment service providers.

7.1. If insurance services are integrated into the platform, they will apply under the terms set by the insurance company. 7.2. If insurance is not available, the lessee is fully responsible for any damage, loss, or late return of the item. 7.3. The platform is not responsible for the quality or condition of items, nor for the actions of lessees.

8.1. The platform is not responsible for: • disputes between users; • the quality, condition, or suitability of rented items; • any damage or loss incurred while using rented items. 8.2. The platform’s liability is limited solely to the provision of technological services (application, payment intermediation).

9.1. Users’ personal data is processed in accordance with applicable legislation and the Privacy Policy. 9.2. The Privacy Policy forms an integral part of these Terms.

10.1. Disputes shall first be resolved through negotiations by contacting the platform’s customer service. 10.2. If an agreement cannot be reached, disputes shall be settled in the courts of the Republic of Lithuania under applicable law.

11.1. The Company reserves the right to amend the Terms by notifying users in advance on the platform. 11.2. Amendments take effect from the date of publication, unless otherwise specified.

12.1. These Terms are governed by the laws of the Republic of Lithuania. 12.2. If any provision of the Terms is found invalid, the remaining provisions shall remain in force.
